Legal Information Regarding Konik Products
The following legal provisions are quoted directly from official European Union legislation and international agreements relevant to Advanced Driver Assistance Systems (ADAS).
Vienna Convention on Road Traffic
Article 8(5bis)
“Vehicle systems which influence the way vehicles are driven shall be deemed to be in conformity with paragraph 5 of this Article and with paragraph 1 of Article 13, when they are in conformity with the conditions of construction, fitting and utilisation according to international legal instruments concerning wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles.
Vehicle systems which influence the way vehicles are driven and are not in conformity with the aforementioned conditions of construction, fitting and utilisation, shall be deemed to be in conformity with paragraph 5 of this Article and paragraph 1 of Article 13 when such systems can be overridden or switched off by the driver“
Regulation (EU) 2019/2144
General Safety Regulation (GSR)
Recital (15)
“Drivers might also need to override advanced emergency braking system or emergency lane keeping system where the functioning of the system could lead to greater risk or harm. This would ensure that the vehicles are under the driver’s control at all times.”
Article 7(4)(d)
“Advanced emergency braking systems and emergency lane-keeping systems shall meet the following requirements in particular: it shall be possible for the driver to override such systems.”
Directive 2007/46/EC
Article 28(1)
“Member States shall not prohibit, restrict or impede the registration, sale, entry into service or use on the road of vehicles, components or separate technical units on grounds relating to aspects of construction and functioning covered by this Directive if they satisfy its requirements.”
Conclusion
The Konik A1M is designed with these principles in mind. It does not replace the driver or assume responsibility for driving the vehicle. Instead, it enables the driver to determine how supported vehicle functions are used while maintaining the driver’s authority over the vehicle.
